Government of the Republic of Moldova Approves New Immigration Law for Foreign Nationals

The Government of the Republic of Moldova has approved a draft of a new law regulating the entry, stay, and supervision of foreign nationals in Moldova. This legislation establishes clear, transparent, and predictable rules, balancing the country’s openness with the protection of national security and its economic interests.

«The draft law benefits both foreign nationals seeking residence in Moldova and the state. Individuals who may pose a security risk will be identified promptly, while foreign nationals are required to demonstrate sufficient means of subsistence. At the same time, Moldova becomes more attractive to investors and highly skilled professionals», stated Daniela Misail-Nichitin.

Key Provisions of the New Immigration Law

The law defines 23 distinct purposes of stay for foreign nationals, including:
● Employment and Highly Skilled Work – Foreign nationals may legally work and carry out professional activities in compliance with the approved regulations.
● Self-Employment and Independent Activities – Entrepreneurs and independent professionals are provided with predictable and transparent conditions for legal residence.
● Education and Research – Students, postgraduates, researchers, and interns can participate in educational and research programs with clearly defined rights and responsibilities.
● Exchange and Internship Programs – Including international student exchanges, Au pair programs, intra-corporate transfers (ICT), and professional training through internships.

Digitalization and Simplification of Administrative Procedures

The law introduces modern digital mechanisms to simplify processes for foreign nationals:
● Online submission of applications for all types of stay.
● Introduction of a unified Residence Card, replacing multiple documents and simplifying interaction with public authorities.
● Reduction of bureaucracy and shorter processing times for administrative procedures.

Support for Economic Growth and Investment

The draft law strengthens foreign investment and labor mobility in Moldova:
● Clear rules for domestic employers and international investors.
● Possibility of short-term employment of up to 90 days in sectors experiencing workforce shortages.
● Enhanced competitiveness of Moldova in the international labor market.

Statistics on Foreign Nationals in Moldova

By the end of 2025, over 21,500 foreign nationals and stateless persons from more than 130 countries were registered in Moldova:

● Permanent residence: over 5,600 individuals
● Temporary stay: approximately 16,000 individuals

These statistics highlight the importance of legislative reforms and the need for a modern regulatory framework governing the legal status of foreign nationals in the country.

Implementation and Impact

Once adopted by the Parliament of the Republic of Moldova, the law will enter into force on June 1, 2027, replacing the current Law on the Regime of Foreign Nationals.

The new law establishes Moldova as a modern, open, and secure country for foreign nationals, investors, and highly skilled professionals, creating a predictable and safe environment for residence, work, and education.
